2025 H770 Additions. Our Auuditor needs Cast Vote Records to do a true forenic audit.


H770 Revival & Sponsorship- NCEIT is requesting the following be added to a draft bill being reviewed:

(1) Designated responsibility for the State Board to develop and publish rules under the APA for receiving and timely processing citizen requests for Cast Vote Records;

(2) Language instructing county boards to make these Cast Vote Records available in a common electronic file format within five days following the closing of polls; and

(3) Language instructing the State Board to develop and publish rules under the APA for incorporating Cast Vote Records into the process for post-election tabulation audits.

(4) Also requesting access to Corresponding Ballot images as well.

Gentlemen;


In the wake of the unusual voting anomalies witnessed and reported this election cycle, it is IMPERATIVE you complete passage of H770, still languishing in Senate Rules.  This bill received bipartisan House support in 2023 and crossed over successfully to the Senate where it has not moved.  Had this bill been passed, you would have empowered the new Auditor with artifacts from this election that could be used to audit the election outcome, and to explain away why several important races flipped during canvass.  Without cast vote records, the auditor lacks the tools needed to perform a post-election tabulation audit.  As it stands now, there is no audit and there will be no audit of the most recent election.  (The "Risk Limiting Audit" that NCSBE performs on itself has zero meaningfulness from a statistical and evidentiary perspective.  Everyone knows that.)


The lack of legislative action by the State Senate on this bill contributes to public distrust of our elections.  Moreover, it greatly complicates the new Auditor's ability to ensure the NCSBE does its job effectively.  You have the opportunity now to fix this glaring deficiency.   There are two or more scheduled sessions of the NCGA prior to adjournment.  Please endeavor to pass this bill and then to override the likely gubernatorial veto that will ensue.  This action is very important to citizens statewide.
