The NCGOP State Party Chair (Jason Simmons) National Committeeman (Ed Broyhill) and the National Committeewoman (Kyshia Brassington) all signed off on Republican National Committee (RNC) paperwork invoking RNC Rule 11 which authorized the RNC to throw its financial and operational support to Michael Whatley over all Republican rivals in preparation for the March 2026 primary election.

This actions are in direct violation of Article IXF, of the NCGOP State Plan of Organization which prohibits the use of one's position in the party to favor any candidate facing a party primary. Moreover, these staff lied to party members by claiming that the Rule 11 authorization was solely for purposes of creating a Joint Fundraising Agreement with the RNC that would aid the primary winner.

The three leaders knew that that claim not to be valid. There is no languate in the RNC rules documents that might be construed as requiring Rule 11 for any other purpose other than for a state party granting permission for the RNC to interfere in a state primary.
