  • Republicans Score Win in Court Battle Over Pennsylvania Ballot Requirements

    Mail-in ballots without dates, or with incorrect dates, should not be counted, federal appeals court rules. View Epoch Times Post here. A state law in Pennsylvania that requires mail-in ballots to be dated is legal, a federal appeals court has ruled. The law, which says that voters must fill out, date, and sign envelopes containing the ballots, is not prevented by the Civil Rights Act of 1964, a majority said in the March 27 ruling. That act bans denying “the right of any individual to vote in any election because of an error or omission on any record or paper relating to any application, registration or other act requisite to voting.” But that provision “only applies when the state is determining who may vote,” U.S. Circuit Judge Thomas Ambro, appointed by former President Bill Clinton, wrote for the majority of a U.S. Court of Appeals for the Third Circuit panel. “In other words, its role stops at the door of the voting place. The provision does not apply to rules, like the date requirement, that govern how a qualified voter must cast his ballot for it to be counted.” The same court ahead of the 2022 election ruled that state officials must count undated ballots, but the U.S. Supreme Court vacated that order. After the state’s acting secretary of state said counties should still count undated ballots, the Pennsylvania Supreme Court ruled that counties could not count mail-in ballots with missing or incorrect dates. About 7,900 ballots were not counted in the 2020 election because they were missing a signature or date or had an inaccurate date, according to state officials. U.S. District Judge Susan Paradise Baxter later ruled that the Pennsylvania law violated the Civil Rights Act provision, meaning Pennsylvania officials had to count mail-in ballots even if they lacked dates or contained inaccurate dates. According to the law, a voter casting a ballot by mail must mark the ballot and then place it inside a provided envelope. That envelope must then be placed into a second envelope, which contains the areas for the date and signature. “The elector shall then fill out, date and sign the declaration printed on such envelope,” the law states. “This is a crucial victory for election integrity and voter confidence in the Keystone State and nationwide. Pennsylvanians deserve to feel confident in the security of their mail ballots, and this Third Circuit ruling roundly rejects unlawful left-wing attempts to count undated or incorrectly dated mail ballot,” Michael Whatley, the RNC’s chairman, said in a statement after the new ruling was handed down. Groups that sued over the law expressed disappointment. “If this ruling stands, thousands of Pennsylvania voters could lose their vote over a meaningless paperwork error. The ballots in question in this case come from voters who are eligible and who met the submission deadline,“ Mike Lee, executive director of the American Civil Liberties Union of Pennsylvania, said in a statement. ”In passing the Civil Rights Act, Congress put a guardrail in place to be sure that states don’t erect unnecessary barriers that disenfranchise voters. It’s unfortunate that the court failed to recognize that principle. Voters lose as a result of this ruling.” The ruling can be appealed to the U.S. Supreme Court, but the groups have not yet indicated whether they'll appeal. Justice Samuel Alito has said that the Pennsylvania law did not appear to violate the Civil Rights Act provision because it did not deny people the right to vote. “When a mail-in ballot is not counted because it was not filled out correctly, the voter is not denied ’the right to vote,'” he said previously. “Rather, that individual’s vote is not counted because he or she did not follow the rules for casting a ballot.” Several other justices supported his view, offered in a dissent when the rest of the court initially said Pennsylvania counties could keep counting undated ballots. Judge Ambro offered a similar rationale, writing that the provision “targets laws that restrict who may vote” and “does not preempt state requirements on how qualified voters may cast a valid ballot, regardless what (if any) purpose those rules serve.” He was joined by U.S. Circuit Judge Cindy Chung, who was appointed by President Joe Biden. U.S. Circuit Judge Patty Shwartz, an appointee of President Barack Obama and the third member of the panel that ruled, said in a dissent that the provision “means that state actors cannot deprive a voter of the right to vote due to an error or omission he makes on papers that he must complete to have his ballot counted, including on papers distinct from application or registration forms, if the mistake is not relevant to the State’s ability to ascertain whether he is qualified under state law to vote in the election.”

Brian Kemp sign the bill into law. The Georgia state legislature passed GOP-backed Senate Bill 189 last week, which now awaits Kemp’s signature or veto. The bill would grant access to Georgia’s ballot to any political party that has qualified for the presidential ballot in at least 20 states — a change that could boost independent candidate Robert F. Kennedy, Jr. and potentially draw votes away from President Biden. The bill also makes ballots, once certified, immediately available as public record in an effort to increase the scope of poll watchers on Election Day. It also makes audits of voter rolls easier, to ensure deceased residents or those who have moved out of state are no longer eligible to vote. LIBERAL GROUPS SUE TO BLOCK NEW ALABAMA VOTING LAW BANNING BALLOT HARVESTING Georgia Republican Gov. Brian Kemp. Hans von Spakovsky, an election law expert and former member of the Federal Election Commission, said the Georgia legislature, through measures like Senate Bill 189, is trying to address several administration problems highlighted in the 2020 election. "The Georgia legislature has been trying to correct the vulnerabilities that allowed some of those administrative problems to creep in," von Spakovsky told Fox News Digital in an interview. Von Spakovsky, who also served on the Board of Advisors of the U.S. Election Assistance Commission and on the Fulton County Board of Registrations and Elections, praised the measure as an effort to make future elections "as transparent as possible." MAIL-IN BALLOTS MUST HAVE DATES ON ENVELOPES, PENNSYLVANIA APPEALS COURT RULES Georgia's Senate Bill 189 will make ballots, upon certification, public record in an effort to increase the scope of poll watchers. Andrea Young, executive director of the American Civil Liberties Union (ACLU) in Georgia, has said the legislation violates the National Voter Registration Act (NVRA), and threatened to sue if it becomes law. Among other things, the NVRA, signed by President Bill Clinton in 1993, bans states from removing registered voters from voter rolls unless certain criteria are met. "The majority in the Georgia General Assembly persists in passing laws that will undermine our democracy," Young told local news station FOX 5. "This is a recipe for election chaos, and we strongly urge the governor to veto it." But von Spakovsky said he doesn’t see anything in the state’s measure that would violate the NVRA, and says that similar legal challenges in other states have failed. He also noted that claims by President Biden two years ago that other Georgia election reforms — like requiring ID for absentee ballots — were a mechanism to suppress minority voters and amounted to "Jim Crow 2.0" have proven to be false. Von Spakovsky noted that a survey conducted by the University of Georgia found that precisely 0% of Black respondents said that they had a "poor" experience voting in 2022, compared to 0.9% of White voters. Philosophy professor Greg Schulz “alleged they breached the contract by violating his academic freedom, and he believes he’s been satisfactorily made whole,” said Dan Lennington, deputy counsel at the Wisconsin Institute of Law and Liberty, a nonprofit public interest law firm that took up Schulz’s case on behalf of free speech. When he was booted off campus without warning in February 2022, Schulz still had five years left on his tenured contract. After Schulz published an article criticizing his and other campuses’ use of race and sex as hiring criteria, acting university president William Cario ordered campus security to ban Schulz from campus, Schulz and Lennington told The Federalist then. Schulz couldn’t even clean out his office or access his campus email, he said. Several lawyers argued this clearly breached Schulz’s contract with Concordia. That contract required that all firings be voted on by the university’s board of regents and that tenured professors have access to a detailed dispute resolution process before any adversarial actions. CUW has not responded to a Federalist request for comment. The situation became a minor uproar in the church body in control of Concordia, the 1.8-million-member Lutheran Church-Missouri Synod (of which this author is a communing member). Pastors, professors, and church members across the denomination expressed concern publicly and privately to church leadership. Local, regional, and national church councils expressed disapproval of CUW’s actions and opposition to identity politics, also known as leftist racism and cultural Marxism. Two years ago, after visiting campus and interviewing approximately 80 people who did not include Schulz, LCMS President Matthew Harrison issued a public letter. It called for two of the 18-member board of regents to resign, the university to review its “diversity” initiatives and align them with Christian theology, and for the university to “demonstrate repentance” for its “…adoption of secular worldviews and agendas.” The two regents Harrison identified did resign. Cariou retired in December. Lennington says the church district overseeing CUW plans to appoint a “circuit visitor” to review diversity initiatives at Concordia, which has long offered a Black Student Union and recently opened a Latino Student Union. The Black Student Union recommended the historically inaccurate 1619 Project and Ibram X. Kendi’s work to students. Kendi openly advocates for systemic government discrimination against people with lighter skin colors. Concordia also maintains a “bias reporting system.” Those are known for harassing students and professors for their speech. After The Federalist reported on the system last year, its name appears to have been changed. On Monday, Concordia announced layoffs to address annual deficits of $2 million to $6 million in five of the last six years, according to the Milwaukee Journal-Sentinel. Earlier this year, CUW announced it intends to close its campus in Ann Arbor, Michigan, also due to budget concerns. “Enrollment fell from nearly 6,000 students in 2016 to nearly 4,400 in the 2021-22 school year, the latest federal data available,” according to the Journal-Sentinel. Including Ann Arbor, the LCMS will have closed four colleges since 2018 due to declining enrollment and resulting budget crises. The closed colleges also had problems with leftist race and sex politics conflicting with Christian teaching. The LCMS is currently in a legal dispute with Concordia University Texas in Austin, which rejects church attempts to assert authority and address serious theological problems at the school. In the two years he’s been suspended, Schulz has written a book about his experiences with DEI in the church and taught theology abroad. Schulz has two doctorates and is a retired Air Force lieutenant colonel. While Schulz’s contractual concerns are resolved with this agreement, Lennington said, his concerns as a pastor and theologian about his former employer’s embrace of anti-Christian and discriminatory “diversity, equity, and inclusion” initiatives are not. “We would like the university to reaffirm its commitment to academic freedom,” Lennington said. “It’s not going to help its reputation and recruitment if they can’t make a simple statement that they will respect professors’ free speech and due process rights.” ========================================================================== Joy Pullmann is executive editor of The Federalist, a happy wife, and the mother of six children.
